Will of John Priestnall of Stockport (Gentleman) - Died 7th December 1859 at Heaton Norris, County of Lancaster

Administration

Proven at Manchester Registry on the 28th December 1859 by the oaths of Reverend Ralph Kinder, of Lumb in the Forest of Rossendale in the said county, clerk, the nephew, and Sarah Priestnall, of 19 Old Road, Heaton Norris, aforesaid, spinster, the sister of the deceased, the executors to whom administration was granted.

Will

This is the last Will and Testament of me John Priestnall of Heaton Norris in the County of Lancaster, Gentleman.
First I Will and direct that all my just debts funeral and testamentary expenses shall be paid by my executors hereinafter named with all convenient speed after my decease.
I give and bequeath unto my dear sister Sarah Priestnall the use and enjoyment of all my household goods and furniture and of all other my personal estate and effects whatsoever and wheresoever which I shall have any power to dispose of by will at the time of my decease. To hold to her my said sister and receive and apply the income and proceeds thereof for her own use and benefit for and during her natural life and from and immediately after her decease and in the mean time subject thereto, I give and bequeath all and singular my said personal estate and effects whatsoever and wheresoever unto and equally between and amongst my nephew the Reverend Ralph Kinder and his three sisters my nieces Frances Sarah Parker Kinder, Anne Kinder and Parnell Amelia Kinder and their respective executors, administrators and assigns as tenants in common and not as joint tenants.
And as to for and concerning all and singular my messuages or dwelling houses, lands, rents, hereditaments and real estate situate and being in or arising in Stockport or Heaton Norris aforesaid or elsewhere of which I or any other person or persons in trust for me or my use is are or may be seized in possession, reversion, remainder or otherwise howsoever, and also all such other real estate (if any) as I may hereafter acquire and have any power to dispose of by will at the time of my decease (except mortgage and trust estates), I  give and devise the same unto and to the use of my said dear sister Sarah Priestnall and her assigns for the term of her natural life and from and immediately after her decease and in the meantime subject thereto, I give and devise the same unto and to the use of my said nephew Ralph Kinder and my said three nieces Frances Sarah Parker Kinder, Anne Kinder and Parnell Amelia Kinder and their respective heirs and assigns equally share and share alike as tenants in common and not as joint tenants.
And as to for and concerning all such real estates and hereditaments as is or are or shall or may be vested in me upon any trusts or by way of mortgage at the time of my decease, I do hereby give and devise the same with their respective appurtenances unto my said nephew Ralph Kinder and my said sister Sarah Priestnall, their heirs and assigns. To hold unto and to the use of them the said Ralph Kinder and Sarah Priestnall, their heirs and assigns nevertheless as to such trust, estates upon such trusts, and as to mortgage estates with such powers of sale and otherwise and subject to such equities as I held the same subject to at the time of my decease and as to any principal or other monies secured to me by such mortgages as part of my personal estate.
And I do hereby nominate, constitute and appoint my said nephew Ralph Kinder and my said sister Sarah executor and executrix of this my will.
And lastly I do hereby revoke all Wills, Codicils and Testamentary dispositions made by me at any time or times heretofore and declare this only to be my last Will and Testament.
In witness whereof I the said John Priestnall the Testator have to this my last Will and Testament confirmed in five sheets of paper (affixed together at the top) set my hand in manner hereinafter mentioned (that is to say) my hand at the bottom of the first sheet thereof and also at the foot or end of my said Will this eighth day of February in the year of our lord one thousand eight hundred and fifty nine, and acknowledged by the above named John Priestnall the testator as and for his last will and testament in the presence of us being both present at the same time who at his request and in his presence and in the presence of each other have hereunto subscribed our names on attestation and as witnesses thereto.
